Terms and Conditions of Use

By subscribing to Beam Konnect services, you agree to be bound by these Terms and Conditions.

1. INTRODUCTION

Agreement Overview

These Terms and Conditions ("Terms") govern the relationship between Beam Konnect ("we", "us", "our", "the Company") and you ("Customer", "Subscriber", "User") regarding the use of our internet services, equipment, and related offerings. By subscribing to or using any Beam Konnect service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

These Terms constitute a legally binding agreement between you and Beam Konnect. If you do not agree with any part of these Terms, you may not use our services.

Important Notice: These Terms apply to all Beam Konnect Fixed Wireless plans services. Specific service plans may have additional terms outlined in your service agreement or plan description.

2. SERVICE ELIGIBILITY & REQUIREMENTS

Who Can Subscribe

To subscribe to Beam Konnect services, you must:

  • Be at least 18 years of age
  • Provide accurate and complete personal information during registration
  • Be the owner or authorized representative of the property where service will be installed
  • Have a valid South African ID or registration document
  • Provide proof of residence within our service coverage area

We reserve the right to verify your identity and eligibility before activating any service. We may refuse service to any person for any lawful reason.

3. SERVICE PLANS & PRICING

Available Plans

Beam Konnect offers various internet service plans with different speeds, data allowances, and pricing structures as described on our website and promotional materials. Key details include:

  • Beam Go (R199/month): Up to 5Mbps Download, Up to 5Mbps Upload, Connect up to 6 devices
  • Beam Smart (R249/month): Up to 8Mbps Download, Up to 4Mbps Upload, Ideal for streaming and busy households

No Hidden Fees: We do not charge hidden installation or activation fees. All costs are disclosed upfront before service activation.

Price Changes: We may change our pricing from time to time. We will provide you with at least 30 days' notice of any price increase. You may cancel your service without penalty if you do not agree to the new pricing.

4. PAYMENT TERMS

Billing and Payment

By subscribing to Beam Konnect services, you agree to:

  • Pay all charges associated with your selected service plan
  • Make payments on or before the due date specified on your invoice (typically by the 7th of each month)
  • Maintain a valid email address for electronic invoicing
  • Update your contact information promptly if it changes

Late Payments: If payment is not received by the due date, we may suspend your service after providing written notice. A reactivation fee may apply for reconnection after suspension.

Payment Methods: We accept electronic funds transfer (EFT), debit orders, and credit card payments. You authorize us to process payments using your selected payment method.

5. INSTALLATION & EQUIPMENT

Installation Services

We offer installation services for all new service activations within our coverage area. Installation includes:

  • Site survey to determine optimal equipment placement
  • Mounting of required antenna or equipment (if applicable)
  • Connection of equipment to your premises
  • Basic setup and connectivity testing

Installation Fee: A once-off installation fee of R500 applies. This fee covers the cost of equipment setup, configuration, and ensuring your connection is stable and reliable.

Equipment Ownership: All equipment provided by Beam Konnect remains our property unless otherwise stated. You are responsible for the safekeeping of this equipment and must return it in good condition (normal wear and tear excepted) upon service termination.

Equipment Damage: You will be liable for the replacement cost of any equipment that is lost, stolen, or damaged due to negligence, unauthorized handling, or improper use.

5.1. PAYMENT & SERVICE SUSPENSION POLICIES

Important Payment Terms

No Pro-Rata Billing: We do not offer pro-rata billing as this is a monthly unlimited service. We invoice monthly usage of the service. All payments that are made between the 1st and 25th of the month are for the invoice of that same month you have received.

Late Payment Suspension: An unpaid invoice on the 1st of every month results in a service suspension on the 3rd day after the grace period. Service will only be restored once full payment has been received.

Pay and Use - No Contracts: Our service operates on a "pay and use" basis with no long-term contracts. However, after 3 months of suspended service due to non-payment, we reserve the right to come and uninstall the network equipment. A reinstallation fee will apply if you wish to resume service after equipment removal.

Summary of Payment Terms:

  • Billing Period: Monthly, invoiced on the 1st of each month
  • Payment Window: 1st - 25th of the month (for the current month's invoice)
  • Grace Period: 1st - 3rd of the month
  • Suspension: Service suspended from the 4th of the month if unpaid
  • Equipment Removal: After 3 consecutive months of suspension
  • No Pro-Rata: Monthly unlimited service billed monthly
6. SERVICE AVAILABILITY & PERFORMANCE

Service Commitments

We strive to provide reliable and consistent internet service. However, you acknowledge that:

  • Advertised speeds are "up to" speeds and may vary based on network conditions, location, time of day, and other factors
  • Service may be affected by weather conditions, power outages, or maintenance activities
  • Coverage availability varies by location and is subject to network capacity

Service Interruptions: We will make reasonable efforts to notify you in advance of planned maintenance that may affect service. We are not liable for service interruptions beyond our reasonable control.

7. ACCEPTABLE USE POLICY

Prohibited Activities

You agree to use Beam Konnect services only for lawful purposes. You may NOT use our services to:

  • Engage in illegal activities or violate South African law
  • Download, upload, or distribute copyrighted material without authorization
  • Transmit viruses, malware, or harmful code
  • Send spam, phishing emails, or unsolicited commercial messages
  • Hack, disrupt, or attempt to gain unauthorized access to networks or systems
  • Access or distribute child exploitation material (zero tolerance - we will report to authorities)
  • Engage in activity that excessively consumes network resources affecting other users

Violation of this Acceptable Use Policy may result in immediate service suspension or termination without refund.

8. FAIR USAGE POLICY

Network Management

Beam Konnect operates on a Fair Usage Policy (FUP) to ensure a quality experience for all users. Under this policy:

  • Usage patterns are monitored to prevent network congestion
  • Excessive bandwidth consumption may result in temporary speed throttling during peak hours
  • Normal browsing, streaming, and work activities are unaffected

We will notify you if your usage is considered excessive. Fair Usage thresholds vary by plan and are detailed in your service agreement.

9. CANCELLATION & TERMINATION

How to Cancel

Customer-Initiated Cancellation: You may cancel your service at any time by providing 30 days' written notice via email to support@beamkonnect.co.za or by calling our support line.

Early Termination: Since we offer no-contract services, there are no early termination fees. You may cancel at any time.

Equipment Return: Upon cancellation, you must return all Beam Konnect-owned equipment within 14 days. Failure to return equipment will result in charges for the replacement value.

Company-Initiated Termination: We may suspend or terminate your service immediately if:

  • You breach these Terms or our Acceptable Use Policy
  • You fail to pay amounts due after notice
  • We reasonably suspect fraud or illegal activity
  • We discontinue the service in your area
10. LIMITATION OF LIABILITY

Liability Disclaimer

To the maximum extent permitted by South African law:

  • We provide services "as is" and do not warrant uninterrupted or error-free service
  • We are not liable for indirect, incidental, or consequential damages arising from service use
  • Our total liability is limited to the amount paid by you for services in the 12 months preceding any claim
  • We are not responsible for loss of data or content transmitted via our network

Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence.

11. INDEMNIFICATION

Your Responsibility

You agree to indemnify and hold harmless Beam Konnect, its directors, employees, and affiliates from any claims, damages, losses, or expenses arising from:

  • Your use of our services in violation of these Terms
  • Your violation of any applicable laws or regulations
  • Your infringement of third-party rights
  • Any content transmitted through your account
12. PRIVACY & DATA PROTECTION

How We Handle Your Information

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our POPIA Privacy Policy. By using our services, you consent to the processing of your personal information as described in that policy.

We may monitor network traffic for security, maintenance, and performance purposes. This monitoring does not involve inspecting the content of your communications without lawful authority.

13. FORCE MAJEURE

Events Beyond Our Control

We will not be liable for any delay or failure to perform our obligations under these Terms due to causes beyond our reasonable control, including but not limited to:

  • Natural disasters (floods, earthquakes, fires, storms)
  • Acts of government or regulatory authorities
  • Power outages or infrastructure failures
  • Labor disputes or strikes
  • Cyber attacks or network security breaches
14. GOVERNING LAW & DISPUTE RESOLUTION

Legal Framework

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your use of our services shall be resolved as follows:

  • Informal Resolution: You agree to first contact us to attempt to resolve any dispute informally
  • Mediation: If informal resolution fails, both parties agree to attempt mediation through an accredited mediator
  • Arbitration: If mediation fails, disputes shall be resolved through binding arbitration under the rules of the Arbitration Foundation of Southern Africa (AFSA)

Nothing in this section prevents either party from seeking injunctive relief from a court of competent jurisdiction.

15. MODIFICATIONS TO TERMS

Changes to This Agreement

We may modify these Terms from time to time. We will notify you of material changes by:

  • Email notification to the address on file
  • Notice on our website
  • Notice on your invoice or account portal

Continued use of our services after the effective date of modifications constitutes acceptance of the revised Terms. If you do not agree to the changes, you may cancel your service without penalty within 30 days of notice.

16. GENERAL PROVISIONS

Additional Terms

  • Entire Agreement: These Terms constitute the entire agreement between you and Beam Konnect regarding our services
  • Severability: If any provision is found invalid, the remaining provisions remain in full force
  • No Waiver: Our failure to enforce any right does not waive our right to enforce it later
  • Electronic Communications: You agree to receive electronic communications from us regarding your account
